A Biddeford man is facing charges after allegedly exposing himself to a 13-year-old Augusta boy during a dance camp held at Winthrop High School last month.
The alleged incident occurred while Keith R. Nadeau, 19, was out on bail pending a trial on charges leveled in December that he had child pornography on his computer while a student at the University of Maine at Farmington.
Nadeau was arrested Aug. 18 at his mother's Biddeford home following a weeklong investigation by Winthrop police. He was charged with visual sexual aggression against a child, a misdemeanor and violating conditions of his release.
Nadeau, who was released on $5,000 cash bail, has pleaded not guilty to the charges, said his attorney, Kevin Joyce.
Nadeau is scheduled to appear in Augusta District Court on Oct. 7, though Joyce is hoping to transfer the case to Kennebec County Superior Court.
"This case is going to be treated very seriously," Kennebec County District Attorney Evert Fowle said.
Nadeau, who has been held at the Franklin County Jail since Friday, is scheduled to appear in Franklin County Superior Court on Sept. 11 for a motion to revoke his bail.
The UMF student was originally charged with possession of sexually explicit material, a felony, in December after he allegedly showed another student photos of young children performing sex acts, Ted Blais, UMF's public safety director, said at the time.
Nadeau was released on $3,000 bail on that charge and was ordered to have no contact with children younger than 16.
But those conditions were amended in May to allow Nadeau to work as an instructor at Saco-based dance company called "It's Showtime, Folks," Joyce said.
According to a Winthrop police affidavit, the Saco dance company's Web site lists Debra J. Lombard as the director and choreographer of the dance camps, which are for children age 6 and older.
The program's Web site has since been removed.
Lombard could not be reached for comment, but Joyce confirmed that Nadeau had been a student or instructor at the children's dance camp for a number of years.
The agreement struck with the Franklin County District Attorney's office allowed Nadeau supervised contact with children, Joyce said. Prosecutors also required written confirmation that Lombard was aware of the charges pending against Nadeau.
"She did not say, 'I will supervise him on a one-on-one basis,'" Joyce said. "She certainly said, 'I know Keith, and I am fully aware of what he has pending in Franklin County.'"
Calls to the Franklin County District Attorney's office were not returned.
Winthrop's Harmony Lattin, whose children had attended the dance camps in Saco, helped organize the dance camp at Winthrop High School so that other families in the area could take advantage.
The camp was in session two hours a day for four days, said Lattin, whose children participated. Lombard never mentioned the charges pending against Nadeau in Franklin County, Lattin said.
"She knew that and she didn't give the parents the option if they wanted to put their kids in that circumstance," Lattin said. "She decided and then she didn't watch them carefully."
According to an affidavit filed by Officer Paul Ferland of the Winthrop police, Nadeau exposed his genitalia to the boy as the two were alone in a locker room before a performance on July 24. The boy also told police that Nadeau masturbated in front of him before the boy ran from the room.
The boys' mother called police on Aug. 11 when the boy told his parents what had happened, Ferland wrote in the affidavit.
"He's a brave little boy," Lattin said. "I'm very grateful to this child for speaking up."
Nadeau maintains nothing inappropriate took place, Joyce said.
"There are some details that have been provided that absolutely did not take place," he said. "I certainly hope the truth comes out in regards to what did or did not happen."
