Allegedly met 16-year-old again

AUGUSTA -- A former Monmouth Academy teacher free on bail after allegedly sexually assaulting a 16-year-old student was arrested early Tuesday and charged with violating a court order by meeting the girl.

Christopher I. Dumaine, 39, of Readfield had been under surveillance by police. He was taken into custody by Maine State Police detectives and brought to the Kennebec County jail in Augusta at 4:15 a.m., according to jail records.

Court documents filed by Kennebec County Deputy District Attorney Alan Kelley say police saw Dumaine and the same 16-year-old girl named as the victim in the sex assault case together on a private road leading to her house later Tuesday morning.

"Detective Adam Kelley recognized the victim as she exited the defendant's vehicle and told her to go to her residence as he took the defendant into custody," according to the state's motion to revoke Dumaine's bail.

The girl told officers "she did not want to say anything that would get the defendant in trouble," according to court documents.

The district attorney's petition to revoke bail says police watched Dumaine leave his house late Monday night or early Tuesday and return in the time it would have taken to drive from his Readfield residence to the victim's home, then return to his house. Police saw the two leave Dumaine's house early Tuesday morning and drive back to the girl's home, according to Kelley's memo.

Dumaine had been charged Oct. 11 with two counts of gross sexual assault and two counts of unlawful sexual contact. The alleged incidents took place between June 1 and Sept. 14, during a period in which he was the girl's teacher.

All the charges name the same girl as the victim.

Dumaine pleaded not guilty Oct. 11 and was freed on $500 bail with conditions that ban him from contact with the girl, her family, and students and faculty at Monmouth Academy, as well as unsupervised contact with any girl younger than 18.

That same day, his wife, Selene A. Dumaine of Readfield, filed for a divorce in Augusta District Court, citing grounds of adultery and irreconcilable differences. The couple married on Aug. 10, 1996, in Kennebunkport. They have two children. The court file does not include a response from Christopher Dumaine.

Dumaine taught at Monmouth Academy, his alma mater, for 16 years before resigning abruptly Sept. 17.

He is scheduled to appear on the criminal case in Augusta District Court via video link today at 1 p.m.

"We're trying to make sure that he's held without bail," said District Attorney Evert Fowle. "There's no excuse that I can think of that would justify his complete disregard of the court order."

"We are gathering information concerning the allegation now and will address this more fully at tomorrow's court appearance," said Dumaine's attorney, Walter McKee. "I expect to request that the court re-release him on bail tomorrow."

His wife filed for divorce yesterday on the same day he landed back in jail for violating his LOW $500.00 cash bail conditions, which also included no unsupervised contact with any girl under the age of 18.
Again, and as D.A. Fowle stated, "We're trying to make sure that he's held without bail." "There's no excuse that I can think of that would justify his complete disregard of the court order."
So, an increased bail, or a revocation of the current bail and held without while awaiting trial or plea agreement?? Stay tuned.....

Increased bail does nothing. Bail is to make sure that the defendant does indeed show up for court. Obviously, the only way to insure the man does not continue to flagrantly violate the law while awaiting trial will be to remain in custody until his court date.

Was my daughter I'd kick her ass. She didn't know better before, she would after. She's only sixteen, but she seems as dumb as he is.

Him? What to say? He's stupid. Nothing she can do for him that he couldn't have done himself, or gone to his wife for, and he wouldn't have any problems at all. Now, well, it speaks for itself doesn't it? report abuse

I assume this girl or victim is a handful for her parents. Not sure what she was doing out so late on a Tuesday night. This man needs to spend time in jail until his court date and then longer til sentencing. The man is not very bright to be doing this. Makes one wonder if this is the first time he had done this. Parents need to be in control here and it appears that the 16 year old is. There is more than one guilty party here.report abuse

Seems this girl is as much at fault as he is. Some 16 year olds do have the mind of someone much older and if she is a "victim" what the hell is she doing meeting him? I would think that when contact was made, the police should have been notified. Where are her parents in all of this? Sleeping too sound to hear their daughter exit the house late at night? Soemthing rotten in Denmark in this case, me thinks. And isn't the age of consent for "sexual activites" 16, in this state?? I think she was a willing partner and should shoulder some of the blame here.report abuse
