If these People had the knowledge of The Common Law they could have falsified the case from the beginning with the Proper Use of Denials with Offers of Proof amounting to Various Forms of Estoppel, which does falsify the whole proceeding for the fraud and a whole lot of other things directly and indirectly involved. Most attorneys do not know about this and most would not do this. It is too easy to be done. I know for I have done these things and I am not an attorney.report abuse

Andrea, These tactics have been used by the rich and/or powerful in Maine for generations. You are not alone. Citizens that are poor or uneducated or even middle class but without extra resources often have land stolen by that method.

You go out a buy a piece of property then years and years later a back dated plot plan pops up and is registered you don't even know anything about it... and voila you loose your land just like that. The State is just using time tested methods of extortion. It would be nice if all land surveryors and lawyers had integrity but that is not the case, not even close. It would be nice if the court system was there to provide justice but that is also not often the case. Those folks have all the money, all the power, and all the expert lawyers...a common citizen has nothing.

Most of those thefts occur within a community with the support of town officials and because the common citizen usually does not have the resources to access the court these thefts just quietly happen and it happens often. Town officials are very familiar with this process of relieving good people of their property.

The State most always kept above the fray and mostly held itself to a higher standard. It is not necessary or even expedient for them to do so now. They no longer have to worry about the court system so can hold themselves above the law.report abuse
